Myco-Emporium Terms of Use

Welcome to Myco-Emporium, a division of The Mushroom Network, LLC
(“TMN,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to our site, purchases,
and participation in our ecosystem. If you don’t agree, please don’t use the site or purchase our products.
1. General Conditions
- Myco-Emporium is an educational, artistic, and experiential platform dedicated to fungi, entomology, natural curiosities, and community. We’re science-friendly, art-obsessed, and ecosystem-minded.
- You must be at least 18 (or the age of majority where you live) to purchase, adopt Myco-Pets, or participate in workshops.
- We may limit, suspend, or terminate accounts, orders, or participation for violations of these Terms, unsafe practices, fraud, or abuse.
- We may update these Terms at any time. Continued use after changes means you accept the updated Terms. See “Last updated” date above.
- DBA: Myco-Emporium operates as a division of The Mushroom Network, LLC and may also operate under a local DBA/assumed name where applicable.
2. Intellectual Property
- All content, logos, designs, names, artworks, photos, videos, products, and branding are the intellectual property of Myco-Emporium and The Mushroom Network unless otherwise noted.
- Unauthorized reproduction, redistribution, or resale of our content or products is prohibited. For licensing questions: support@myco-emporium.com.
- If you upload or submit content (images, video, audio, text), you grant us a non-exclusive, worldwide, royalty-free license to use and display it for educational and promotional purposes, with credit where feasible.
3. Sales, Categories & Disclaimers
All sales are final unless otherwise required by law.
Nature does not do clones — and neither do we.
Expect natural variation and handmade quirks. By purchasing, you accept responsibility for safe handling, setup, and storage.
(a) Bug-Relics (Dead / Preserved Specimens)
Scope:
Our “Bug-Relics” are nature’s eternal wonders — framed butterflies, dragonflies, moths, beetles; resin charms & keychains; petri dish resin art; wet specimens (jars, vials, potion globes, holiday balls); and limited runs like “Ghost-Wings” and “Potion-Relics.” Each is a fusion of art and preservation designed for collectors, oddity lovers, and science enthusiasts.
Ethics & Sourcing:
We take sourcing seriously. Whenever legally possible, butterflies, dragonflies, and moths are collected on our own property in Live Oak, Florida, under careful and sustainable practices. Specimens may be labeled (when possible) with species name, year collected, and general location they were found. For internal tracking, we use a colored micro-dot system so Myco-Emporium can identify which specimens were locally sourced.
Non-native species or those not collected locally are obtained only from licensed, ethical breeders, trusted vendors, or accredited zoos/education programs. All such specimens are legally deceased prior to receipt —
we do not import live specimens into Florida. This ensures full compliance with Florida Fish & Wildlife Commission (FWC) regulations and any applicable federal or international laws (such as CITES).
We do not deal in endangered or illegally acquired specimens.
Every Bug-Relic comes with the peace of mind that it was sourced and handled according to the law and with respect for nature.
When you adopt a Bug-Relic, you’re supporting ethical entomology and responsible artistry.
Fragility & Reality:
Specimens are delicate by nature. Minor scale loss, pin shifts, or micro-bubbles in resin may occur in shipping. These are normal and do not affect the integrity of the piece. Every Bug-Relic is unique — there are no duplicates in nature.
Care Instructions:
Display away from direct sunlight, humidity, and pests (e.g., dermestids). Keep shadow-box frames sealed. Clean only with gentle dusting — avoid liquids or abrasive cleaners.
Ownership Transfer:
Responsibility for specimens transfers to you upon delivery by the carrier (see §5 “Shipping & Risk of Loss”). We pack with care, but cannot guarantee against improper handling once shipped.
(b) Myco-Pets (Live Specimens – Class III License)
Scope:
Captive-bred, ethically sourced Myco-Companions such as Asian Black Forest Scorpions, Florida Ivory & Bumblebee Millipedes, Green/Albino Pac-Man Frogs, Leopard Geckos (select morphs), Jumping Spiders (i.e. Regals), and feeder crickets, mealworms, and other live feeder insects; curated bundles like Starter Habitat Packs and the Myco-Pet Mini Zoo.
Risks & Reality Check:
These creatures are incredible — but not plushies. Myco-Pets may bite, pinch, scratch, sting, jump, secrete irritants, or trigger allergies/emotions. We provide FREE SPORETACULAR GUIDES and myco-support; once adopted, you are the handler and accept all handling risks.
Your Guardian Obligations:
- Follow all local, state, and federal laws on ownership, transport, and species restrictions. Verify legality in your jurisdiction before ordering.
- Provide species-appropriate enclosure, secure lids, correct temperature/humidity, substrate/enrichment, and consistent food/water.
- No Release — Ever: These are captive-bred livestock. Releasing them is dangerous for the animal and the ecosystem (we’re not recreating the Burmese python mess anywhere).
- Practice safe handling (tongs, catch cups, gloves when recommended). Keep away from unattended children and pets.
Mandatory Adoption Agreement:
Every Myco-Pet order requires a digital signature on our Myco-Pet Adoption Agreement at checkout. By signing, you pledge no wild release, proper care, humane treatment, and that you’ll contact us for rehoming if you can’t continue care. Orders won’t complete without this signature.
Returns & Rehoming:
Can’t continue care? Contact us. We accept returns for rehoming at no cost to you. We may issue store credit or modest compensation at our sole discretion after assessing the animal’s condition and rehome readiness. This is a welfare net, not a buy-back scheme.
Live Arrival & Shipping Windows:
We ship during safe weather windows with appropriate packing. Someone must receive live shipments on the first attempt. Delays, extreme temps, or post-delivery mishandling can be fatal. See §5.
Liability Waiver:
Myco-Emporium and The Mushroom Network, LLC are not responsible for injuries, allergic reactions, escapes, property damage, veterinary costs, or legal consequences linked to Myco-Pets. Adoption = acceptance of risks.
Ethics First:
Adoption makes you a Myco-Guardian — part of a stewardship-first community. We’re here to help, responsibly.
(c) Oddity-Orbs (Prank / Fun Line)
Scope:
Bug Bath Bombs (fizzy/scented, revealing resin bug or toy), seasonal gags (e.g., Halloween skull fizzies, holiday bug balls), and kid-friendly “Mini-Creepers” with safe toy critters.
- Safety & Use: For external use only. Keep out of eyes and mouths. Some products contain small parts — choking hazard; not for children under 3.
- Allergies & Sensitivities: Check ingredients for fragrance/color sensitivities. Discontinue use if irritation occurs.
- Prank Responsibly: These are for fun — not for causing panic, harm, or damage. Be cool; be kind.
(d) Myco-Garden (Plants & Pollinator Products)
Scope:
Seasonal plants (e.g., Passion Flower, Mulberries, Blackberries, Goldenrod, Lantana), air plants (Tillandsia), pollinator seed packets, and occasional “Grow-Your-Own Habitat” kits.
- Local Rules: You’re responsible for ensuring plants/seeds are permitted in your region (some jurisdictions restrict certain species/seeds).
- Live Plant Variability: Plant size/appearance varies by season and growth stage. Minor cosmetic stress in transit is normal; follow included revival/care tips.
- Garden Ethics: Plant responsibly to support pollinators and avoid invasive spread. When in doubt, ask us — or your local extension office.
(e) Emporium-Creatives (Creative / Collectible Products)
Scope:
Handcrafted art, limited-run creations, 3D-printed displays/frames/holders, collab pieces (butterfly jars, resin art), and our massive sticker emporium (entomology, mushrooms, psychedelic, holographic, nature, spiritual, etc.) — with rotating bundle deals.
- Artisanal Variance: Expect slight color/finish differences between batches, printers, and devices. That’s the charm of small-run creative work.
- License & Use: Unless explicitly licensed for commercial use, products are for personal use/display only. No redistribution/resale of digital assets without a license.
- Sticker Offers: Pricing/promos (e.g., “1 for $1,” “6 for $3,” “15 for $5,” “10-Sticker Mystery Pack for $4”) may rotate by event and channel.
(f) Myco-Emporium Fungal Line
Scope:
The Myco-Emporium Fungal Line celebrates the artistry, science, and educational exploration of mushrooms and mycology. Offerings may include spore print artwork; Colony Preservation Vials/Tubes (CPV/CPT) intended for long-term genetic archiving; limited-run liquid culture syringes; spore swabs where legally permitted; and select partner products such as mycorrhizal soil boosters, specialty substrates, or grow accessories.
Intended Use & Legal Responsibility:
All Myco-Emporium Fungal Line products are intended for lawful purposes only, including microscopy, education, research, collection, and ornamental or scientific use where applicable. Customers are solely responsible for understanding and complying with all federal, state, and local laws within their jurisdiction. Products must not be used, modified, or applied in any manner that violates applicable regulations.
Species Restrictions & Compliance:
We do not sell, support, or condone reckless, unlawful, or non-compliant activity of any kind. Myco-Emporium does not offer restricted, prohibited, or controlled mushroom genetics. Our focus remains on widely legal, non-restricted, and beneficial species, including but not limited to Lion’s Mane, Reishi, Oyster mushrooms, Turkey Tail, Chicken of the Woods, Maitake, Shiitake, and other legally permissible varieties. Any product availability is subject to change based on evolving regulations and compliance standards.
Sterility & Handling Disclaimer:
Unless a product is explicitly labeled as sterile, it should be assumed to be non-sterile. Proper clean technique, appropriate lab practices, and responsible handling are essential when working with cultures, prints, or related materials. Contamination is a natural risk inherent to biological study; educational resources and best-practice guidance are provided to support informed and responsible use.
Partner & Third-Party Products:
Third-party or partner-supplied items, including soil amendments, mycorrhizal products, or grow accessories, are governed by the manufacturer’s specifications, limitations, and warranties (if any). Compatibility, performance, and outcomes may vary depending on environmental conditions, substrates, and user methods. Myco-Emporium makes no claims beyond those expressly stated by the product originator.
4. Health & Safety Disclaimer
- Products are not intended for medical, diagnostic, or therapeutic use.
- Myco-Pets, Live Specimens, and preserved specimens may trigger allergies or adverse reactions (venoms, setae, molds). Handle responsibly, respect posted cautions, and use PPE where advised.
- Wash hands after handling live or preserved specimens, substrates, or chemicals. Keep handling areas clean and secure.
- We disclaim liability for injuries, illnesses, infestations, contamination, or accidents arising from misuse, neglect, or environmental conditions outside our control.
5. Shipping & Risk of Loss
- Windows & Methods: Shipping varies by product. Live shipments go out during safe weather windows with appropriate packing. We may hold your order until a safe window opens.
- Receipt: You must be available for the first delivery attempt on live shipments. Failure to receive on first attempt voids any live-arrival courtesies.
- Risk Transfer: Risk of loss passes to you upon carrier delivery. We are not responsible for carrier delays, theft after delivery, or damage post-delivery.
- Address Accuracy: Double-check your shipping info. We cannot reship for free due to address errors.
6. Limitation of Liability
To the maximum extent permitted by law:
- Myco-Emporium and The Mushroom Network, LLC disclaim all warranties, express or implied, regarding products, services, timeliness, or fitness for a particular purpose.
- We are not liable for indirect, incidental, punitive, or consequential damages, including injuries from bites, stings, pinches, scratches, allergic reactions, contamination, or environmental exposures.
- Your sole remedy for dissatisfaction is to stop using our site and products. Where limitations aren’t allowed, our liability is limited to the maximum permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless Myco-Emporium, The Mushroom Network, and our owners, affiliates, employees, and partners from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use/misuse of our site, products, or services; your breach of these Terms; or your violation of any law or third-party rights.
8. Governing Law
- These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
- Exclusive venue lies in the state or federal courts of Suwannee County, Florida, and you consent to such jurisdiction and venue.
